# How to sell a car that failed inspection

> In many states you can sell a car that failed inspection, because passing is the next owner's job when they register it. Some states put it on the seller: California requires the seller to give the buyer a valid smog certificate for most cars. Selling to a junk buyer or yard usually avoids the problem, because the car won't be registered again, but tell every buyer about the failure in writing.

A failed emissions or safety inspection doesn't stop you from selling a car in many states. What matters is whether your state makes the seller or the buyer responsible for the inspection, and whether the buyer plans to drive the car or scrap it. Disclose the failure either way.

## Who's responsible for the inspection

States handle this in roughly three ways:

1. **The seller must provide a passing result.** California is the main example: the seller gives the new owner a valid smog certification when selling.[^1]
2. **The buyer must inspect after registering.** In New York, a vehicle must be inspected when ownership changes. A buyer from someone other than a registered dealer gets an extension of 10 days from registration, and the previous owner's inspection doesn't carry over.[^2]
3. **No inspection for most private cars, or only in some counties.** Texas ended safety inspections for non-commercial vehicles on January 1, 2025, but still requires emissions inspections before registration in 17 counties.[^3]

If you sell to a junk car buyer or yard, the car usually won't be registered for the road again, so the buyer's inspection requirement typically doesn't come up. Even California exempts vehicles transferred to be wrecked or dismantled from its smog requirement.[^5] Confirm with the buyer how they'll handle the title. In some states junk buyers retitle cars or surrender the title for destruction.

## What affects the price of a car that failed

Buyers want to know **why** it failed, because the fix decides its value:

| Failure | What it usually means for a buyer |
|---|---|
| Check engine light, minor sensor | Often a cheap fix. A buyer who repairs cars may pay close to normal value. |
| Catalytic converter or major emissions part | Expensive to fix. Many buyers price the car as a junk car, though the converter itself has scrap value. See [catalytic converters and junk cars](/guides/catalytic-converter-and-junk-cars/). |
| Brakes, tires, lights | Usually fixable. The car may still have value as a driver. |
| Frame rust, structural or suspension failure | Often the end of the car's road life, so it's priced for parts or scrap. |
| Engine or transmission problems | See [blown engine](/guides/sell-car-with-blown-engine/) or [bad transmission](/guides/sell-car-with-bad-transmission/). |

To decide between fixing and selling, compare the repair estimate with what the car is worth in [junk or repair](/guides/junk-or-repair-car/).

## Selling as is and what to disclose

The FTC says private sales usually aren't covered by state implied warranties, so a private sale is probably "as is" unless the agreement says otherwise.[^6] The FTC's Used Car Rule, which requires dealers to post a Buyers Guide saying whether a car comes with a warranty or is sold as is, applies to dealers who sell more than five used vehicles in a 12-month period.[^4] A one-time private seller doesn't post a Buyers Guide, but disclosing the problems you know about protects you from disputes later. Protect yourself:

- **Keep the inspection report** and give the buyer a copy.
- **Write it on the [bill of sale](/guides/bill-of-sale-for-junk-car/)**: "Sold as is. Failed [state] [emissions/safety] inspection on [date] for [reasons]."
- **Don't promise it will pass** or call it "an easy fix" unless you know that's true.
- **In states where the seller must provide the inspection**, follow that rule or confirm in writing which exemption applies before you sign.

## Steps to sell a car that failed inspection

1. **Get the written inspection result** and the list of reasons.
2. **Check your state's rule**: who's responsible for the inspection on a sale? Start at [junk car laws by state](/junk-car-laws/).
3. **Get a repair estimate** if the fix might be cheap.
4. **Decide: repair, sell to a private buyer, or sell to a junk buyer or yard.** For a junk sale you can [get an offer for your car](/cash-for-junk-cars/) and compare yards in the [junkyard directory](/junkyards/).
5. **Disclose the failure** in your listing and on the bill of sale.
6. **Sign the title over** and file your [release of liability](/guides/release-of-liability/).
7. **Cancel insurance and registration.** See [cancel insurance and registration after selling](/guides/cancel-insurance-and-registration-after-selling/).

## State examples

- **California.** The seller must give the buyer a valid smog certification. Cars less than four years old don't need a smog inspection when sold, and the buyer pays a smog transfer fee instead. The DMV's smog exemptions include gasoline vehicles from 1975 or older, diesel vehicles from 1997 or older, and electric vehicles.[^1] Vehicles transferred to be wrecked or dismantled are also exempt from the smog requirement.[^5] Details: [California junk car laws](/junk-car-laws/california/).
- **New York.** Vehicles are inspected every 12 months and when ownership is transferred. Buyers from someone other than a DMV-registered dealer get 10 days from registration to pass inspection, and an inspection issued to the previous registrant isn't valid. Most inspections combine a safety check and an onboard-diagnostics emissions check.[^2] Details: [New York junk car laws](/junk-car-laws/new-york/).
- **Texas.** Since January 1, 2025, non-commercial vehicles don't need a safety inspection to register. Emissions inspections are still required before registration in Brazoria, Collin, Dallas, Denton, Ellis, El Paso, Fort Bend, Galveston, Harris, Johnson, Kaufman, Montgomery, Parker, Rockwall, Tarrant, Travis and Williamson counties.[^3] Details: [Texas junk car laws](/junk-car-laws/texas/).

Inspection programs change, as Texas shows. Check your state agency's current rules before you sell.

## When junking is the better choice

If the failure means expensive repairs on an older car, a junk sale is usually simpler. The buyer prices the car for its parts and metal, and you don't have to fix anything. ## Questions people ask

**Is it legal to sell a car that failed inspection?**

Usually, yes. In many states the inspection is tied to registering the car, which is the buyer's job. A few states make the seller responsible for certain inspections, such as California's smog certificate rule, so check your state.

**Do I need a smog check to sell my car to a junkyard in California?**

No, if the car is being junked. California's general rule is that the seller gives the buyer a valid smog certificate, but the DMV says vehicles transferred to be wrecked or dismantled are exempt from the smog inspection requirement.

**Can I sell a car 'as is' after it failed inspection?**

Private sales are usually as is unless your agreement says otherwise, but you should still tell the buyer about the failed inspection. Write the result and the reasons on the bill of sale and keep a copy of the inspection report.

**Should I fix it before selling?**

Only if the repair costs less than the value it adds. For an old car that needs major emissions or safety work, selling it as is to a junk buyer is often the better choice.
